1. Introduction and Acceptance

Welcome to Mehndi.uk. These Terms of Service ("Terms") govern your access to and use of the Mehndi.uk website, mobile applications, and services (collectively, the "Platform"). The Platform is operated by Mehndi.uk ("we", "our", or "us").

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and Mehndi.uk. Please read them carefully before using our services.

2. Definitions

For the purposes of these Terms:

  • "Platform" refers to the Mehndi.uk website (mehndi.uk), any associated mobile applications, and all related services, features, and content.
  • "User" refers to any individual or entity that accesses or uses the Platform, including Vendors, Couples, and general visitors.
  • "Vendor" refers to any business or individual that provides wedding-related services and has a listing on the Platform, whether claimed or unclaimed.
  • "Couple" refers to individuals planning a wedding who use the Platform to find, compare, and contact Vendors.
  • "Listing" refers to a Vendor's profile page on the Platform, including business information, photos, reviews, and contact details.
  • "Enquiry" refers to a message sent by a Couple to a Vendor through the Platform's communication system.
  • "Subscription" refers to a paid membership plan that provides enhanced features and visibility for Vendors.
  • "Content" refers to all text, images, videos, reviews, and other materials uploaded to or displayed on the Platform.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Platform, you must create an account. You may register using your email address or through third-party authentication providers (such as Google). By creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised access or use of your account

3.2 Account Types

The Platform offers the following account types:

  • Couple Account: For individuals planning a wedding, providing access to vendor search, shortlists, enquiries, and planning tools.
  • Vendor Account: For businesses offering wedding services, providing access to listing management, enquiry responses, and analytics.

3.3 Age Requirement

You must be at least 18 years old to create an account or use the Platform. By creating an account, you represent and warrant that you meet this age requirement.

3.4 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We will not be liable for any loss or damage arising from your failure to protect your account information.

4. Vendor Listings and Claims

4.1 Listing Sources

Vendor listings on the Platform may be created from publicly available information or submitted directly by Vendors. We strive to ensure accuracy but cannot guarantee all information is current or complete.

4.2 Claiming a Listing

If you are the owner or authorised representative of a business listed on the Platform, you may claim that listing by:

  • Creating a Vendor account
  • Submitting a claim request with verification documents
  • Completing our verification process

We reserve the right to approve or reject claim requests at our discretion. False claims may result in account termination and legal action.

4.3 Listing Status

Listings may have one of the following statuses:

  • Unclaimed: The listing has not been verified by the business owner.
  • Claimed: A claim request has been submitted and is pending review.
  • Verified: The listing has been verified and is managed by the business owner.
  • Suspended: The listing has been temporarily or permanently removed due to policy violations.

4.4 Vendor Obligations

Vendors with claimed or verified listings agree to:

  • Provide accurate and up-to-date business information
  • Respond to enquiries in a timely and professional manner
  • Deliver services as described in their listings
  • Comply with all applicable UK laws and regulations
  • Not engage in fraudulent, misleading, or deceptive practices
  • Maintain appropriate insurance and licenses for their services

5. Couple Usage Terms

5.1 Platform Use

Couples may use the Platform to:

  • Search for and browse wedding vendor listings
  • Save vendors to shortlists for comparison
  • Send enquiries to vendors through the Platform
  • Leave reviews based on genuine experiences
  • Use planning tools such as checklists and calendars

5.2 Couple Obligations

Couples agree to:

  • Use the Platform for legitimate wedding planning purposes only
  • Provide accurate information when submitting enquiries
  • Not misuse the enquiry system for spam or solicitation
  • Leave honest and fair reviews based on genuine experiences
  • Respect vendors' time and respond to communications appropriately

5.3 Booking and Payments

Any bookings or payments made between Couples and Vendors are conducted directly between those parties. Mehndi.uk is not a party to such transactions and accepts no liability for disputes arising from them.

6. Enquiries and Communications

6.1 Enquiry System

The Platform provides a messaging system that allows Couples to send enquiries to Vendors. By using this system, you agree that:

  • Enquiries may be monitored to ensure compliance with these Terms and to prevent abuse
  • We may send notifications about enquiry activity via email or other channels
  • Contact information shared through enquiries may be used by the recipient

6.2 Communication Standards

All communications through the Platform must:

  • Be professional, courteous, and relevant
  • Not contain offensive, discriminatory, or harassing content
  • Not include unsolicited commercial communications (spam)
  • Not attempt to circumvent the Platform's systems

6.3 Response Expectations

While we encourage timely responses to enquiries, we cannot guarantee that Vendors will respond to all messages. Response times may vary based on Vendor availability and subscription tier.

7. Reviews and User Content

7.1 Review Guidelines

Reviews must be based on genuine experiences with the Vendor's services. When submitting a review, you agree that:

  • Your review is honest, accurate, and reflects your personal experience
  • You have actually used the Vendor's services
  • You have no personal or business relationship with the Vendor that could bias your review (unless disclosed)
  • Your review does not contain defamatory, offensive, or illegal content
  • You are not being compensated for your review

7.2 Content License

By submitting content to the Platform (including reviews, photos, and other materials), you grant Mehndi.uk a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, display, distribute, and create derivative works from such content in connection with the Platform and our business operations.

7.3 Content Ownership

You retain ownership of any content you submit, but you confirm that:

  • You have the right to submit the content
  • The content does not infringe any third-party rights
  • The content complies with all applicable laws

7.4 Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms or is otherwise objectionable, without prior notice. Repeated violations may result in account termination.

7.5 Vendor Responses

Verified Vendors may respond to reviews publicly. Responses must be professional and comply with the same standards as reviews.

8. Subscriptions and Payments

8.1 Subscription Plans

Vendors may purchase subscription plans to enhance their listings and access additional features. Current subscription tiers include:

  • Free: Basic listing with limited features
  • Pro: Enhanced visibility and additional photos
  • Premium: Priority placement and advanced features
  • Elite: Maximum visibility and dedicated support

8.2 Payment Processing

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service. We do not store your complete payment card details on our servers.

8.3 Billing Cycle

Subscriptions are billed on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew unless cancelled before the renewal date.

8.4 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Existing subscribers will be notified of any price changes before they take effect.

8.5 Taxes

All prices are displayed exclusive of VAT unless otherwise stated. VAT will be added where applicable based on your location and our tax obligations.

9. Cancellation and Refunds

9.1 Cancellation by Subscriber

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • You will retain access to paid features until the subscription expires
  • Your listing will revert to the Free tier after expiration

9.2 Refund Policy

Refunds may be provided at our discretion in the following circumstances:

  • Within 14 days of initial purchase: Full refund available if you are not satisfied with the service (cooling-off period under Consumer Contracts Regulations 2013)
  • Technical issues: Pro-rata refund if we are unable to deliver the promised service due to technical problems on our end
  • Duplicate charges: Full refund for any accidental duplicate payments

9.3 Refund Process

To request a refund, contact us at billing@mehndi.uk with your account details and reason for the refund request. Refunds will be processed within 10 business days and credited to the original payment method.

9.4 Non-Refundable Items

The following are not eligible for refunds:

  • Subscriptions cancelled after the 14-day cooling-off period
  • Partial months of service
  • Accounts terminated for Terms violations

10. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

10.1 Account Abuse

  • Creating multiple accounts to circumvent restrictions or bans
  • Sharing account credentials with unauthorised parties
  • Using another person's account without permission
  • Providing false or misleading registration information

10.2 Harmful Content

  • Posting false, misleading, defamatory, or fraudulent content
  • Uploading content that is obscene, offensive, or hateful
  • Posting content that infringes intellectual property rights
  • Sharing personal information of others without consent

10.3 Harassment and Abuse

  • Harassing, threatening, or intimidating other users
  • Engaging in discriminatory behaviour
  • Stalking or unwanted persistent contact
  • Impersonating another person or entity

10.4 Technical Abuse

  • Attempting to gain unauthorised access to the Platform or its systems
  • Using automated tools to scrape, collect, or harvest data without permission
  • Interfering with the proper functioning of the Platform
  • Uploading malware, viruses, or other harmful code
  • Circumventing security measures or access restrictions

10.5 Commercial Misuse

  • Using the Platform for purposes other than wedding planning or services
  • Sending unsolicited commercial messages (spam)
  • Advertising competing services on the Platform
  • Manipulating reviews or ratings through fake accounts or incentives

10.6 Legal Violations

  • Violating any applicable local, national, or international laws
  • Engaging in money laundering or other financial crimes
  • Facilitating illegal activities through the Platform

11. Intellectual Property

11.1 Platform Ownership

The Platform, including its design, features, functionality, and content (excluding User Content), is owned by Mehndi.uk and is protected by copyright, trademark, patent, and other intellectual property laws of the United Kingdom and international treaties.

11.2 Trademarks

"Mehndi.uk", our logo, and other marks displayed on the Platform are trademarks of Mehndi.uk. You may not use these marks without our prior written consent.

11.3 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for its intended purposes. This license does not include:

  • Any resale or commercial use of the Platform or its contents
  • Any collection or use of listings, descriptions, or other data
  • Any derivative use of the Platform or its contents
  • Any downloading or copying of account information

11.4 Copyright Complaints

If you believe that content on the Platform infringes your copyright, please contact us at legal@mehndi.uk with:

  • A description of the copyrighted work
  • The location of the infringing content on the Platform
  • Your contact information
  • A statement of good faith belief that the use is not authorised
  • A declaration that the information is accurate under penalty of perjury

12. Disclaimers and Limitations

12.1 Platform as a Directory

Mehndi.uk is a directory service that connects Couples with Vendors. We are not a party to any transactions between Users and do not:

  • Guarantee the quality, safety, or legality of Vendor services
  • Verify the accuracy of all Vendor claims, qualifications, or credentials
  • Guarantee that Vendors will fulfil their obligations
  • Mediate or resolve disputes between Users
  • Provide insurance or guarantees for transactions

12.2 Service Availability

We strive to maintain Platform availability but cannot guarantee uninterrupted access. The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

12.3 Limitation of Liability

To the maximum extent permitted by applicable law, Mehndi.uk shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from Vendor services or conduct
  • Damages arising from third-party content or services
  • Damages exceeding the amount paid by you (if any) in the preceding 12 months

12.4 User Responsibility

Users are solely responsible for conducting their own due diligence before engaging Vendors. We recommend:

  • Verifying Vendor credentials, licenses, and insurance
  • Reading reviews and asking for references
  • Using written contracts for all bookings
  • Making payments through secure, traceable methods

12.5 Statutory Rights

Nothing in these Terms shall affect your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mehndi.uk, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Platform
  • Any services you provide (for Vendors)
  • Any dispute between you and another User

We reserve the right to assume exclusive defence and control of any matter subject to indemnification by you, at your expense.

14. Termination

14.1 Termination by User

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

  • Your access to the Platform will be revoked
  • Any active subscriptions will be cancelled (subject to our refund policy)
  • Your public profile and listings will be removed or anonymised
  • We may retain certain data as required by law or for legitimate business purposes

14.2 Termination by Mehndi.uk

We may suspend or terminate your account at our discretion, with or without notice, if we believe you have:

  • Violated these Terms or any applicable laws
  • Engaged in fraudulent, abusive, or harmful conduct
  • Created risk or legal exposure for Mehndi.uk or other Users
  • Provided false or misleading information

14.3 Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, and indemnification.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating formal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@mehndi.uk. We will attempt to resolve disputes within 30 days.

15.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 European Commission Online Dispute Resolution

If you are a consumer in the European Union, you may access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify registered Users via email
  • Display a prominent notice on the Platform

Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and may request account deletion.

We recommend reviewing these Terms periodically for any updates.
